Terms and Conditions
PROPERTY RISK
All risk in the Products shall pass to the Customer upon delivery to the Customer’s delivery address but 4K Business Services Pte Ltd (hereinafter referred to as “Seller”) shall retain title to the Products until such time as payment for the Products has been effected.
Seller shall use its best efforts to ensure that orders are correctly delivered. Should there be any discrepancy, please email to Seller at oommi.singapore@gmail.com by the next working day.
RETURN POLICY
If a Customer were not satisfied with the purchase, the Customer may request for a full refund within 30 days of collection or delivery. Customer can send to Seller the request via email. Please indicate the order number in the Customer request. Products must be in its original purchasing condition, with all tags attached, and must be returned in the original undamaged box and/or packaging. Once the request is processed, the Customer will receive the refund via the original mode of payment within 14 business days.
LIABILITY
The liability of Seller whether in contract, tort or otherwise for any loss, damage or injury arising directly or indirectly from any defect in or non-compliance of the Products or any other breach of Seller obligations hereunder shall not in any event exceed an amount equivalent to the price of the Products paid by the Customer.
Seller shall not be liable for any consequential, indirect or special damage or loss of any kind whatsoever nor shall Seller be liable for any damage or loss caused by the Customer’s servants, agents, buyers or other persons whatsoever.
The Products shall be accepted by the Customer entirely at the Customer’s risk.
INTELLECTUAL PROPERTY
Oommi Sdn. Bhd. (hereinafter referred to as “OOMMI”) owns the trademark, logos and service marks displayed on this site and/or in connection with the Products and Customers and the Seller is licensed to use the same. The Customer is prohibited from using the same without the written permission of OOMMI, the Seller, or such other parties.
The Customer shall not do anything to prejudice the rights of OOMMI and the Seller.
VARIATION OF TERMS AND CONDITIONS
The Seller reserves the right to amend the Terms and Conditions as and when necessary at its sole discretion. Seller may, but does not undertake to, notify the Customer of such changes. It is the Customer’s responsibility to review the Terms and Conditions prior to submitting any order and Seller shall have no responsibility to notify the Customer of any changes to the Terms and Conditions.
Photographs/designs of the products and packaging are provided on this site to help the Customer to recognise the products. However, the product pictures/designs may be revised and improved as and when necessary without notice.
APPLICABLE LAW
These Terms and Conditions shall be governed by the laws of Singapore and the Customer and Seller agree to submit to the jurisdiction.
PERSONAL DATA
The Customer authorises Seller to collect, retain and use personal information about the Customer for the following purposes:-
Undertaking any dealings or transactions with the Customer and providing continuous services to the Customer;
Sending the Customer any advertising and/or promotional material;
Notifying Customers of special offers or new Products;
Notifying Customer of up-dates to this site;
The Customer is aware that in the event sufficient personal information is not supplied, or is not satisfactory to Seller then his/her application for registration to Seller Online may not be accepted.
The Customer is aware that any personal information supplied by the Customer will be retained by Seller and will be accessible to employees of Seller and other persons or corporate bodies engaged by Seller for or in relation to any of the purposes listed above, or to third parties and the Customer authorises Seller to disclose all or any part of any personal information provided by the Customer to such third parties.
The Customer acknowledges that Seller shall retain all personal information supplied by the Customer and unless otherwise notified to Seller may continue to contact the Customer with marketing information even after the Customer’s registration is cancelled.
CONFIDENTIALITY
Seller shall not sell, rent or lease the Customer’s information to third party.
Personal data held by Seller relating to the Customer shall be kept confidential.
Any questions, comments, suggestions or information other than personal data sent or posted on this site, or any part of this site by the Customer shall deem to have voluntarily provided to Seller on a non-confidential and non-proprietary basis. Seller reserves the right to use, reproduce, disclose, transmit, publish, broadcast and/or post elsewhere such information freely, including passing it to any associated company.
Seller will disclose Customer’s personal data, without notice, only if required to do so by law or in the good faith belief that such action is necessary to:-
Comply with legal process served on Seller or the site; and
Protect and defend the rights or property of Seller.
USERNAME & PASSWORD
The Customer shall take responsibility for the safe-keeping of his/her login email ID and password.
The Customer is liable if his/her login email ID and password are used by an unauthorised person. The Customer shall release and indemnify Seller from any liability arising from the unauthorised use of his/her login email ID or password.
SAFETY OF PERSONAL DATA
All reasonable efforts are made by Seller to ensure that any personal data held by Seller is stored in a secure and safe place and no unauthorised access will be made by Seller to Customer’s browser.
LIMITATION OF LIABILITY
By accessing and using this Seller Online internet site, the Customer acknowledges and accepts that the use of the site is at the Customer’s own risk. Seller shall not be liable for any direct, indirect, incidental, consequential or punitive damage or for damages for lost profits or for loss of revenue arising out of any use of, access to, or inability to use the site. Without limiting the foregoing: THIS SITE AND ALL INFORMATION AND MATERIALS CONTAINED IN IT ARE PROVIDED “AS IS” WITHOUT ANY WARRANTY OF ANY KIND EITHER EXPRESS OR IMPLIED INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OR IMPLIED TERMS AS TO TITLE, QUALITY, MERCHANTABILITY, FITNESS FOR PURPOSE , PRIVACY OR NON-INFRINGEMENT.
